Yes, you will need to set up a corporation that is recognized by the IRS. It can be an LLC or a Corporation. You can hire an attorney to do so or we can show you how to file with the Secretary of State and save you a lot of time and money. Once your LLC is filled it typically takes 4 weeks to finalize. Therefore, we recommend that you stay with your current broker until the process is completed.
Doing Business As "DBA" would need to be filled with Secretary of State.
Commissions will be paid directly from the Title Company or Closing Office to your Brokerage. You will not need to wait for some broker to delay paying you.
By utilizing a Disbursement Authorization Form. We have a template in DotLoop for you to refer to. This way you do not need to cut them a check and your agents will get paid quickly without any delays from your office.
When your Brokerage LLC/Corporation joins the Local Board of Realtors/MLS you will be issued an Office ID #. You and your agents listings will be under your Brokerage Office Name.
Your Brokerage Firm's name will be listed as the Cooperating Broker, Listing or Other Broker on all Real Estate contracts.

You are the owner of your Brokerage Firm. Therefore, you set the commission splits and Desk Fees for your Agents.
The Designated Supervisor of your Brokerage Firm will need to complete the "Brokerage Responsibility" course every two years per TREC continuing education requirements. If your engaged in Commercial Real Estate transactions then you will need the "Commercial Contracts" class at a minimum. We highly encourage expanding your depth of education for any specific market segment or specialty Real Estate involvement. I.E. Luxury, Farm & Ranch, Condos, Commercial, Unimproved.
In order for us to maintain our low cost of sponsorship we do not offer office space. Home Offices has become increasing popular for the agents, and this will save you a lot of money too.
